1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and LogLibro ("Company," "we," "us," or "our") governing your access to and use of the LogLibro digital pilot logbook service, including our website, applications, and related services (collectively, the "Service").

By creating an account, accessing, or using our Service, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you must not use our Service.

Important Notice: These Terms include provisions regarding limitation of liability, disclaimers, and dispute resolution that affect your legal rights. Please read them carefully.

2. Eligibility

To use our Service, you must:

  • Be at least 16 years of age
  • Have the legal capacity to enter into a binding agreement
  • Not be prohibited from using the Service under any applicable laws
  • Provide accurate and complete registration information

If you are using the Service on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.

3. Account Registration and Security

3.1 Account Creation

To access certain features of the Service, you must create an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate and complete.

3.2 Account Security

You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized access or security breach
  • Ensuring your password is strong and unique to LogLibro

3.3 Account Termination

We reserve the right to suspend or terminate your account at any time for violations of these Terms, fraudulent activity, or any other reason we deem necessary to protect our Service or users.

4. Service Description

LogLibro is a digital pilot logbook service that allows pilots to:

  • Record and manage flight log entries
  • Track flight hours across various categories
  • Monitor currency requirements and license milestones
  • Export and print logbook data
  • Access flight analytics and reports

Critical Disclaimer: LogLibro is designed as a supplementary record-keeping tool. This Service is not a substitute for official FAA, EASA, or any other regulatory authority logbooks. Users are solely responsible for maintaining official logbook records as required by applicable aviation regulations.

5. Acceptable Use Policy

You agree to use our Service only for lawful purposes and in accordance with these Terms. You agree NOT to:

  • Enter false, misleading, or fraudulent flight data
  • Use the Service to violate any aviation regulations or laws
  • Attempt to gain unauthorized access to any portion of the Service
  • Interfere with or disrupt the integrity or performance of the Service
  • Upload malicious code, viruses, or any harmful content
  • Use automated systems (bots, scrapers) to access the Service without permission
  • Impersonate another person or entity
  • Use the Service in any way that could damage, disable, or impair the Service
  • Attempt to reverse engineer, decompile, or disassemble any part of the Service
  • Share your account credentials with third parties

6. User Content and Data

6.1 Your Content

You retain ownership of all flight data, remarks, and other content you submit to the Service ("User Content"). By submitting User Content, you grant us a limited, non-exclusive license to store, process, and display your content solely for the purpose of providing the Service to you.

6.2 Data Accuracy

You are solely responsible for the accuracy, completeness, and legality of your User Content. We do not verify flight data entries and are not responsible for any inaccuracies in your logbook records.

6.3 Backup Responsibility

While we implement robust backup systems, we strongly recommend that you maintain your own backup copies of your flight data. We are not responsible for any loss of data, regardless of the cause.

7. Intellectual Property Rights

7.1 Our Rights

The Service, including its original content, features, functionality, design, and underlying technology, is owned by LogLibro and protected by international copyright, trademark, patent, trade secret, and other intellectual property laws. Our trademarks and trade dress may not be used without our prior written consent.

7.2 License to Use

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal, non-commercial purposes as a pilot logbook.

8. Fees and Payment

8.1 Free and Paid Services

Certain features of the Service may be available free of charge, while other features may require payment. We will clearly indicate which features require payment before you access them.

8.2 Payment Terms

If you purchase any paid features:

  • You agree to pay all fees associated with your selected plan
  • All fees are non-refundable unless otherwise stated
  • We may change our fees upon 30 days' notice
  • You are responsible for all applicable taxes

8.3 Subscription Renewals

Subscription plans will automatically renew at the end of each billing period unless you cancel before the renewal date. You can cancel at any time through your account settings.

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND.

To the fullest extent permitted by applicable law, we disclaim all warranties, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranties arising from course of dealing or usage of trade.

We do not warrant that:

  • The Service will meet your specific requirements
  • The Service will be uninterrupted, timely, secure, or error-free
  • The results obtained from using the Service will be accurate or reliable
  • Any errors in the Service will be corrected
  • The Service will be compatible with your device or browser

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • LogLibro and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses.
  • Our total liability for any claims arising from your use of the Service shall not exceed the amount you paid to us, if any, in the twelve (12) months preceding the claim.
  • We shall not be liable for any damages resulting from your reliance on the Service for official aviation record-keeping purposes.

Some jurisdictions do not allow the exclusion or limitation of certain warranties or liability. In such jurisdictions, our liability is limited to the maximum extent permitted by law.

11. Indemnification

You agree to defend, indemnify, and hold harmless LogLibro, its affiliates, and their respective officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising from or related to: (a) your use of the Service; (b) your User Content; (c) your violation of these Terms; (d) your violation of any rights of another party; or (e) your violation of any applicable laws or regulations.

12. Dispute Resolution

12.1 Informal Resolution

Before filing a claim, you agree to first contact us at legal@loglibro.com and attempt to resolve the dispute informally for at least 30 days.

12.2 Binding Arbitration

If we cannot resolve the dispute informally, you agree that any dispute arising from these Terms or your use of the Service will be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except that either party may seek injunctive relief in any court of competent jurisdiction.

12.3 Class Action Waiver

You agree that any arbitration or proceeding shall be limited to the dispute between us and you individually. You waive any right to participate in a class action lawsuit or class-wide arbitration.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any legal action or proceeding not subject to arbitration shall be brought exclusively in the federal or state courts located in Delaware.

14. Changes to Terms

We reserve the right to modify these Terms at any time. When we make changes:

  • We will update the "Last Updated" date at the top of these Terms
  • For material changes, we will provide at least 30 days' notice via email or prominent notice on the Service
  • Your continued use of the Service after changes take effect constitutes acceptance of the new Terms
  • If you do not agree to the modified Terms, you must stop using the Service

15. Termination

15.1 Termination by You

You may terminate your account at any time by contacting us or using the account deletion feature in your settings. Upon termination, your right to use the Service will immediately cease.

15.2 Termination by Us

We may terminate or suspend your account immediately, without prior notice, for any reason, including breach of these Terms.

15.3 Effects of Termination

Upon termination: (a) all licenses granted to you will terminate; (b) you must cease all use of the Service; (c) we may delete your account and User Content after a reasonable retention period; (d) provisions that by their nature should survive termination will survive.
